NPCSC Session Watch: Public Health Laws, Civil Code & Supervision Law Companion Statute

The Council of Chairpersons decided on Thursday (August 15) to convene the 12th session of the 13th NPC Standing Committee (NPCSC) from August 22 to 26. Per the Council’s recommendation, the session will consider seven legislative bills. A quick rundown follows.

NPCSC Session Watch: Securities Law Revision, Civil Code & Foreign Investment Law Implementation

The Council of Chairpersons met last Friday and decided to convene the 10th session of the 13th NPC Standing Committee (NPCSC) from April 20 to 23. The Council also approved the NPCSC’s 2019 legislative and oversight plans, which we expect to be released after the session. Per the Council’s decision, the NPCSC this month will review eight legislative bills. Below we take a brief look at each.

NPCSC Solicits Public Comments on Draft Revision to Civil Servants Law and Three Other Bills

The NPC Standing Committee is now soliciting public comments on the following draft laws until December 1, 2018:

Most notably, the draft revision to the Civil Servants Law seeks to strengthen the Communist Party’s control (or rather codify the Party’s already strengthened control) over China’s civil servants—a broad category that encompasses both those working in governmental bodies and also those working for political parties and other quasi-governmental entities (e.g., the CPPCC). NPCSC Amends Criminal Procedure Law, Overhauls Judicial System Organic Laws, Loosens Stock Buyback Restrictions & Designates SPC as National IP Appeals Court (FURTHER UPDATED)

The 13th NPC Standing Committee (NPCSC) concluded its sixth session on Friday. Below we will take a look at the series of laws and decisions it adopted, with a focus on five of them: an amendment to the Criminal Procedure Law, revisions to the organic laws of courts and procuratorates, an amendment to the Company Law, and a decision altering appeals procedures in technical intellectual property cases.

Analysis: NPC Standing Committee’s 2017 Oversight Plan

The NPC Standing Committee (NPCSC) released its 2017 oversight plan (Plan) in early May, and this post presents an overdue analysis of it. Here, we will not list each and every project in the Plan (unlike our previous analysis of the NPCSC’s 2017 legislative plan), but will instead offer a few observations about the Plan. A partial translation of the Plan, including more detailed descriptions of the projects, can be found at the end of this post.
