按照党中央批准的深化国防和军队改革总体方案,为加快建立军官职业化制度,构建科学规范的军官制度体系,适应现代军队建设和作战要求,第十二届全国人民代表大会常务委员会第二十五次会议决定:军官制度改革期间,暂时调整适用《中华人民共和国现役军官法》、《中国人民解放军军官军衔条例》中军官职务等级、军衔、职务任免、教育培训、待遇保障、退役安置有关规定。具体办法和试行范围,由中央军事委员会组织制定和予以明确。改革措施成熟后,及时修改完善有关法律。
In accordance with the Overall Plan for Deepening Reform of National Defense and the Military as approved by the Central Committee of the Communist Party, in order to accelerate the establishment of a system of career military officers and to build a scientific and standardized system of military officers to meet the requirements for the building and operations of a modern military, the 25th Session of the Standing Committee of the 12th National People’s Congress decides: the application of the relevant provisions in the P.R.C. Law on Officers in Active Service and Regulations on the Military Ranks of People’s Liberation Army Officers on military officers’ position levels, military ranks, appointments and removals, education and training, benefits, and placement upon retirement from active service, is to be temporarily adjusted during the reform of the system of military officers. The Central Military Commission is to organize the formulation and specify the specific measures and the scope of the trial implementation. After the reform measures become mature, the relevant laws are to be promptly amended and improved.
本决定自2017年1月1日起施行。
This Decision takes effect on January 1, 2017.

为推进国家金融战略实施,健全完善金融审判体系,营造良好金融法治环境,促进经济和金融健康发展,根据宪法和人民法院组织法,特作如下决定:
To promote the implementation of the national financial strategy, to perfect and improve the financial adjudication system, to create a favorable rule-of-law environment for finance, and to promote the healthy development of the economy and finance, it is hereby decided as follows on the basis of the Constitution and the People’s Courts Organic Law:
一、设立上海金融法院。
上海金融法院审判庭的设置,由最高人民法院根据金融案件的类型和数量决定。
I. There is established a Shanghai Financial Court.
The setup of the adjudicatory divisions of the Shanghai Financial Court is to be determined by the Supreme People’s Court on the basis of the type and quantity of financial cases.
二、上海金融法院专门管辖上海金融法院设立之前由上海市的中级人民法院管辖的金融民商事案件和涉金融行政案件。管辖案件的具体范围由最高人民法院确定。
上海金融法院第一审判决和裁定的上诉案件,由上海市高级人民法院审理。
II. The Shanghai Financial Court is to exercise exclusive jurisdiction over the civil and commercial cases on finance as well as the finance-related administrative cases that were within the jurisdiction of the intermediate people’s courts in Shanghai before the establishment of the Shanghai Financial Court. The specific scope of the cases under its jurisdiction is to be determined by the Supreme People’s Court.
Cases of appeals from the first-instance verdicts and judgments of the Shanghai Financial Court are to be heard by the Shanghai High People’s Court.
三、上海金融法院对上海市人民代表大会常务委员会负责并报告工作。
上海金融法院审判工作受最高人民法院和上海市高级人民法院监督。上海金融法院依法接受人民检察院法律监督。
III. The Shanghai Financial Court is responsible and report on its work to the Standing Committee of the Shanghai Municipal People’s Congress.
The Shanghai Financial Court’s adjudicatory work is supervised by the Supreme People’s Court and the Shanghai High People’s Court. The Shanghai Financial Court is to accept legal supervision by the people’s procuratorates in accordance with law.
四、上海金融法院院长由上海市人民代表大会常务委员会主任会议提请本级人民代表大会常务委员会任免。
上海金融法院副院长、审判委员会委员、庭长、副庭长、审判员由上海金融法院院长提请上海市人民代表大会常务委员会任免。
IV. As proposed by the Chairpersons’ Meeting of the Standing Committee of the Shanghai Municipal People’s Congress, the President of the Shanghai Financial Court is appointed or removed by the Standing Committee of the People’s Congress at the same level.
The Vice Presidents, members of the Adjudication Committee, Division Chiefs, Deputy Division Chiefs, and adjudicators of the Shanghai Financial Court are appointed or removed by the Standing Committee of the Shanghai Municipal People’s Congress, as proposed by the President of the Shanghai Financial Court.
五、本决定自2018年4月28日起施行。
V. This Decision takes effect on April 28, 2018.

In accordance with the relevant provisions of the Constitution, the 1st Session of the 13th National People’s Congress has decided to establish the Constitution and Law Committee of the National People’s Congress. To specify the duties of the Constitution and Law Committee, the Standing Committee of the National People’s Congress decides:
一、《中华人民共和国全国人民代表大会组织法》《中华人民共和国立法法》《中华人民共和国各级人民代表大会常务委员会监督法》《中华人民共和国全国人民代表大会议事规则》《中华人民共和国全国人民代表大会常务委员会议事规则》中规定的“法律委员会”的职责,由宪法和法律委员会承担。
I. The duties of the “Law Committee” provided in the Organic Law of the National People’s Congress of the P.R.C., P.R.C. Legislation Law, P.R.C. Law on the Oversight by the Standing Committees of the People’s Congresses at All Levels, Rules of the Procedures of the National People’s Congress of the P.R.C., and Rules of Procedures of the Standing Committee of the National People’s Congress of the P.R.C. are to be assumed by the Constitution and Law Committee.
二、宪法和法律委员会在继续承担统一审议法律草案等工作的基础上,增加推动宪法实施、开展宪法解释、推进合宪性审查、加强宪法监督、配合宪法宣传等工作职责。
II. The Constitution and Law Committee, besides continuing to assume such as duties as the unified deliberations of draft laws, is to additionally assume such duties as promoting the implementation of the Constitution, carrying out constitutional interpretation, advancing constitutional review, strengthening constitutional oversight, and cooperating in publicizing the Constitution.

Decision of the Standing Committee of the National People’s Congress on Authorizing the State Council to Conduct Pilot Reform to Allow Hong Kong Legal Practitioners and Macao Practicing Laws to Obtain Qualifications to Practice in the Mainland and to Practice Law in Nine Mainland Cities in the Guangdong–Hong Hong–Macao Greater Bay Area

为促进粤港澳大湾区建设,发挥香港法律执业者和澳门执业律师的专业作用,第十三届全国人民代表大会常务委员会第二十一次会议决定:授权国务院在广东省广州市、深圳市、珠海市、佛山市、惠州市、东莞市、中山市、江门市、肇庆市开展试点工作,符合条件的香港法律执业者和澳门执业律师通过粤港澳大湾区律师执业考试,取得内地执业资质的,可以从事一定范围内的内地法律事务。具体试点办法由国务院制定,报全国人民代表大会常务委员会备案。试点期限为三年,自试点办法印发之日起算。试点期间,国务院要依法加强对试点工作的组织指导和监督检查,就试点情况向全国人大常委会作出报告。试点期满后,对实践证明可行的,修改完善有关法律。
To promote the building of the Guangdong–Hong Kong–Macao Greater Bay Area and to give play to the professional role of Hong Kong legal practitioners and Macao practicing lawyers, the 21st Session of the Standing Committee of the 13th National People’s Congress decides: the State Council is authorized to carry out pilots in the cities of Guangzhou, Shenzhen, Zhuhai, Foshan, Huizhou, Dongguan, Zhongshan, Jiangmen, and Zhaoqing in Guangdong Province, whereby qualified Hong Kong legal practitioners and Macao practicing lawyers who have passed the Guangdong–Hong Kong–Macao Greater Bay Area Legal Professional Examination and have obtained qualifications to practice in the mainland, may practice mainland law within a certain scope. The State Council is to formulate specific measures for the pilots and to record them with the Standing Committee of the National People’s Congress. The period for the pilots is three years, to start on the date of issuance of the pilot measures. During the pilots, the State Council shall strengthen organization, guidance, oversight, and inspection of the pilots according to law, and report to the Standing Committee of the National People’s Congress on the status of the pilots. After the period for the pilots has expired, where they have been proven feasible in practice, the relevant laws are to be amended and improved.
本决定自公布之日起施行。

为加大知识产权司法保护力度,营造良好营商环境,推进中国特色自由贸易港建设,根据宪法和人民法院组织法,特作如下决定:
To strengthen judicial protection for intellectual property rights, create a favorable business environment, and promote the construction of a free trade port with Chinese characteristics, it is hereby decided as follows on the basis of the Constitution and the People’s Courts Organic Law:
一、设立海南自由贸易港知识产权法院。
海南自由贸易港知识产权法院审判庭的设置,由最高人民法院根据知识产权案件的类型和数量决定。
I. There is established a Hainan Free Trade Port Intellectual Property Court.
The setup of the adjudicatory divisions of the Hainan Free Trade Port Intellectual Property Court is to be determined by the Supreme People’s Court on the basis of the type and quantity of intellectual property cases.
二、海南自由贸易港知识产权法院管辖以下案件:
(一)海南省有关专利、技术秘密、计算机软件、植物新品种、集成电路布图设计、涉及驰名商标认定及垄断纠纷等专业性、技术性较强的第一审知识产权民事、行政案件;
(二)前项规定以外的由海南省的中级人民法院管辖的第一审知识产权民事、行政和刑事案件;
(三)海南省基层人民法院第一审知识产权民事、行政和刑事判决、裁定的上诉、抗诉案件;
(四)最高人民法院确定由其管辖的其他案件。
应由海南自由贸易港知识产权法院审理的第一审知识产权刑事案件,由海南省人民检察院第一分院提起公诉。海南省基层人民法院第一审知识产权刑事判决、裁定的上诉、抗诉案件,由海南省人民检察院第一分院依法履行相应检察职责。
海南自由贸易港知识产权法院第一审判决、裁定的上诉案件,由海南省高级人民法院审理,法律有特殊规定的除外。
II. The Hainan Free Trade Port Intellectual Property Court is to exercise jurisdiction over the following cases:
(1) highly specialized or technical first-instance civil and administrative intellectual property cases in the Hainan Province, such as those relating to patents, technical know-how, computer software, new plant varieties, or integrated circuit layout designs, those involving the recognition of well-known trademarks, as well as monopoly disputes;
(2) first-instance civil, administrative, and criminal intellectual property cases that are within the jurisdiction of the intermediate people’s courts in the Hainan Province, other than those provided in the previous item;
(3) cases of appeals or procuratorial protests from the verdicts or judgments of Hainan basic-level people’s courts in first-instance civil, administrative, and criminal intellectual property cases;
(4) other cases that the Supreme People’s Court decides are within its jurisdiction.
The First Branch of the Hainan Provincial People’s Procuratorate is to bring public prosecutions in the first-instance criminal intellectual property cases that should be heard by the Hainan Free Trade Port Intellectual Property Court. The First Branch of the Hainan Provincial People’s Procuratorate is to perform the corresponding procuratorial duties in cases of appeals or procuratorial protests from the first-instance verdicts or judgments of Hainan basic-level people’s courts in criminal intellectual property cases.
Except where laws have special provisions, cases of appeals from the first-instance verdicts or judgments of the Hainan Free Trade Port Intellectual Property Court are to be heard by the Hainan Provincial High People’s Court.
三、海南自由贸易港知识产权法院对海南省人民代表大会常务委员会负责并报告工作。
海南自由贸易港知识产权法院审判工作受最高人民法院和海南省高级人民法院监督。海南自由贸易港知识产权法院依法接受人民检察院法律监督。
III. The Hainan Free Trade Port Intellectual Property Court is responsible and report on its work to the Standing Committee of the Hainan Provincial People’s Congress.
The Hainan Free Trade Port Intellectual Property Court’s adjudicatory work is supervised by the Supreme People’s Court and the Hainan Provincial High People’s Court. The Hainan Free Trade Port Intellectual Property Court is to accept legal supervision by the people’s procuratorates in accordance with law.
四、海南自由贸易港知识产权法院院长由海南省人民代表大会常务委员会主任会议提请海南省人民代表大会常务委员会任免。
海南自由贸易港知识产权法院副院长、审判委员会委员、庭长、副庭长、审判员由海南自由贸易港知识产权法院院长提请海南省人民代表大会常务委员会任免。

一、设立北京金融法院。

II. The Beijing Financial Court is to exercise exclusive jurisdiction over the following cases:
(1) first-instance civil and commercial cases on finance that should be within the jurisdiction of the intermediate people’s courts in Beijing;
(2) first-instance finance-related administrative cases in which a financial regulatory agency is the defendant and that should be within the jurisdiction of the intermediate people’s courts in Beijing;
(3) first-instance civil and commercial cases on finance as well as finance-related administrative cases in which a Beijing-domiciled financial infrastructure institution is the defendant or a third party and that relate to the latter’s performance of duties;
(4) cases of appeals or procuratorial protests from, or retrials of, the verdicts or judgments of Beijing basic-level people’s courts in first-instance civil and commercial cases on finance as well as finance-related administrative cases;
(5) cases that it should enforce according to the provisions of law;
(6) other financial cases that the Supreme People’s Court determines should be within its jurisdiction.
Cases of appeals from the first-instance verdicts or judgments of the Beijing Financial Court are to be heard by the Beijing High People’s Court.
三、北京金融法院对北京市人民代表大会常务委员会负责并报告工作。
北京金融法院审判工作受最高人民法院和北京市高级人民法院监督。北京金融法院依法接受人民检察院法律监督。

第十三届全国人民代表大会常务委员会第二十九次会议审议了国务院关于提请审议《关于授权上海市人民代表大会及其常务委员会制定浦东新区法规的决定(草案)》的议案。为建立完善与支持浦东大胆试、大胆闯、自主改相适应的法治保障体系,推动浦东新区高水平改革开放,打造社会主义现代化建设引领区,第十三届全国人民代表大会常务委员会第二十九次会议决定:
The 29th Session of the Standing Committee of the 13th National People’s Congress has deliberated the State Council’s bill on submitting for deliberation the Decision on Authorizing the Shanghai Municipal People’s Congress and Its Standing Committee to Formulate Pudong New Area Regulations (Draft). To build and improve a system of rule-of-law safeguards suited to the support for Pudong to make bold attempts, forge ahead boldly, and reform independently, to promote the high-level reform and opening-up of the Pudong New Area, and to create a leading zone for social modernization, 29th Session of the Standing Committee of the 13th National People’s Congress decides:
一、授权上海市人民代表大会及其常务委员会根据浦东改革创新实践需要,遵循宪法规定以及法律和行政法规基本原则,制定浦东新区法规,在浦东新区实施。
I. The Shanghai Municipal People’s Congress and its Standing Committee are authorized to formulate, based on the practical needs of reform and innovation in Pudong and pursuant to the provisions of the Constitution as well as the basic principles of laws and administrative regulations, Pudong New Area regulations to be implemented in the Pudong New Area.
二、根据本决定制定的浦东新区法规,应当依照《中华人民共和国立法法》的有关规定分别报全国人民代表大会常务委员会和国务院备案。浦东新区法规报送备案时,应当说明对法律、行政法规、部门规章作出变通规定的情况。
II. The Pudong New Area regulations formulated in accordance with this Decision shall be separately filed with the Standing Committee of the National People’s Congress and the State Council for the record in accordance with the relevant provisions of the P.R.C. Legislation Law. When Pudong New Area regulations are filed for the record, the circumstances of provisions made to vary laws, administrative regulations, or departmental rules shall be explained.
三、本决定自公布之日起施行。

为推动完善我国诉讼制度,明确四级法院审级职能定位,加强审级制约监督体系建设,优化司法资源配置,保障法律正确统一适用,第十三届全国人民代表大会常务委员会第三十次会议决定:
To promote the improvement of China’s litigation system, specify the orientation of the tier-based functions of the four tiers of courts, to strength the construction of a system of tier-based checks and supervision, to optimize the allocation of judicial resources, and to ensure the correct and uniform application of law, the 30th Session of the Standing Committee of the 13th National People’s Congress decides:
授权最高人民法院在本院和北京、天津、辽宁、上海、江苏、浙江、山东、河南、广东、四川、重庆、陕西12个省、直辖市的人民法院组织开展四级法院审级职能定位改革试点工作,就完善民事、行政案件级别管辖制度,完善案件管辖权转移和提级审理机制,完善民事、行政再审申请程序和标准,完善最高人民法院审判权力运行机制等内容开展改革试点。试点期间,试点法院暂时调整适用《中华人民共和国民事诉讼法》第一百九十九条,《中华人民共和国行政诉讼法》第十五条、第九十条。试点工作应当遵循有关诉讼法律的基本原则,充分保障当事人的诉讼权利,坚持依法纠错与维护生效裁判权威相统一,确保司法公正。试点具体办法由最高人民法院组织研究制定,报全国人民代表大会常务委员会备案。试点期限为二年,自试点办法印发之日起算。
The Supreme People’s Court is authorized to organize and carry out reform pilots on the orientation of the tier-based functions of the four tiers of courts at the Court itself as well as at the people’s courts in the twelve provinces and directly governed municipalities of Beijing, Tianjin, Liaoning, Shanghai, Jiangsu, Zhejiang, Shandong, Henan, Guangdong, Sichuan, Chongqing, and Shaanxi—[that is,] to carry out reform pilots on such issues as improving the system of tier-based jurisdiction over civil and administrative cases, improving the mechanisms for transferring the jurisdiction over cases and for elevating the tier for adjudication, improving the procedures and standards for petitioning for a retrial in civil and administrative cases, and improving the operating mechanism of the Supreme People’s Court’s adjudicatory power. During the pilots, the application of article 199 of the P.R.C. Civil Procedure Law and articles 15 and 90 of the P.R.C. Administrative Litigation Law at the pilot courts are to be temporarily adjusted. The pilots shall follow the basic principles of the relevant litigation laws, fully safeguard the parties’ litigation rights, adhere to the unity of correcting errors according to law and preserving the authority of effective judgments, and ensure judicial fairness. The Supreme People’s Court is to organize the research and formulation of specific measures for the pilots and to record them with the Standing Committee of the National People’s Congress. The period for the pilots is two years, starting on the date of issuance of the pilot measures.
最高人民法院应当加强对试点工作的组织指导和监督检查。试点过程中,最高人民法院应当就试点情况向全国人民代表大会常务委员会作出中期报告。试点期满后,对实践证明可行的,应当修改完善有关法律;对实践证明不宜调整的,恢复施行有关法律规定。
The Supreme People’s Court shall strengthen organization, guidance, oversight, and inspection of the pilots. During the pilots, the Supreme People’s Court shall deliver an interim report on the status of the pilots to the Standing Committee of the National People’s Congress. After the period for the pilots has expired, where they have been proven feasible in practice, the relevant laws shall be amended and improved; where the adjustments have been proven inadvisable in practice, the implementation of the relevant legal provisions is to resume.
本决定自公布之日起施行。
This Decision takes effect on the date of promulgation.

Decision of the Standing Committee of the National People’s Congress on Temporarily Adjusting the Application of Relevant Legal Provisions During the Deepening of the Reform of the National Defense Mobilization System

为了深入贯彻党中央关于深化国防动员体制改革的决策部署,依据宪法和《中华人民共和国国防法》,第十三届全国人民代表大会常务委员会第三十一次会议决定:深化国防动员体制改革期间,暂时调整适用《中华人民共和国国防动员法》、《中华人民共和国人民防空法》、《中华人民共和国国防交通法》、《中华人民共和国国防教育法》中有关国防动员以及人民武装动员、经济动员、人民防空、交通战备、国防教育的领导管理体制、军地职能配置、工作机构设置和国防动员资源指挥运用的规定。具体办法按照党中央的有关决定、国务院和中央军事委员会的有关规定执行。改革措施成熟后,及时修改完善有关法律。
To thoroughly implement the Party Central Committee’s decision and deployment on deepening the reform of the national defense mobilization system, and in accordance with the Constitution and the P.R.C. National Defense Law, the 31st Session of the Standing Committee of the 13th National People’s Congress decides: during the deepening of the reform of the national defense mobilization system, the application of the provisions in the P.R.C. National Defense Mobilization Law, P.R.C. Civil Air Defense Law, P.R.C. National Defense Transportation Law, and P.R.C. National Defense Education Law on the leadership and management structure, configuration of military-civilian functions, and working body setup relating to national defense mobilization, as well as to people’s armed mobilization, economic mobilization, civil air defense, transportation war preparedness, and national defense education; and on the command and use of national defense mobilization resources, is to be temporarily adjusted. The specific measures are to follow the Party Central Committee’s relevant decisions as well as the State Council and Central Military Commission’s relevant provisions. After the reform measures become mature, the relevant laws are to be promptly amended and improved.
本决定自2021年10月24日起施行。
